GM trademark attorney Charles Ellerbrock said: “The Studebaker XUV is so similar to the H2 that the public will be confused by the knock off of the H2.”


Avanti is expected to make a response at the Chicago Show on Monday, but Avanti officials have been claiming that their design is boxy and that no-one has a trademark on a box.


GM is seeking a preliminary injunction preventing Avanti Motors from manufacturing, advertising, and selling the Studebaker XUV.


Based in the US state of Georgia, Avanti plans to start manufacturing the $75,000 retail price Studebaker XUV in August, with initial production of 1,000 units per annum.
