BorgWarner Turbo Systems said that a preliminary court decision favoring Honeywell International was being appealed and would not impact the company financial results for the year.
This preliminary decision by the Duesseldorf, Germany court limits BorgWarner’s manufacture of certain variable turbine geometry (VTG) turbochargers in Germany until a patent hearing on December 18.
“We strongly disagree with the court’s decision and are immediately filing an appeal,” said chairman and CEO John Fiedler.
“We will not allow this action to disrupt our customers and are committed to fulfill our commercial obligations and commitments to our customers. We also continue to believe that our current production designs do not violate Honeywell patents and are not covered by their lawsuit.”
