South Korea’s Supreme Court has ordered the fraud case that led to a suspended sentence for Hyundai Motor Chairman Chung Mong-Koo be sent back to a lower court.

The Supreme Court was ruling on an appeal by prosecutors, who claimed Chung’s sentence was too lenient. Although Chung hasn’t appealed his conviction, the Seoul High Court can choose to either retry the whole case, or just review the sentence.


“The case will return to the Seoul High Court for a review,” said Supreme Court spokesman Hong Geum-Pyo.


“It may take two to three months for the lower court to make a ruling again.”


It is not yet clear when the lower court will make a decision to either hear the case again or just review the sentence.


Last year Chung received a three year jail sentence for convictions on the charges of embezzlement and breach of trust. The sentence was later suspended. leaving him free to run the company.
